NTUC Education & Training Fund (NETF) Training Award

DEFINITIONS

Unless the context otherwise requires, the following definitions shall apply for the purposes of this Agreement:

This “Agreement” refers to these Terms and Conditions which may be amended, modified or varied by NETF from time to time.

“National Trades Union Congress”, “NTUC” or words importing a similar effect refers to the National Trades Union Congress, a federation of trade unions in the republic of Singapore and registered under the Trade Unions Act, Cap 333.

“NTUC Education & Training Fund”, “NETF” refers to the fund established with the objective of promoting , assisting and sponsoring programmes for the development of skills and training or re-training of union members. Here, NETF also refers to the Secretary or any other agent appointed by NTUC to administer, run or manage the Fund towards the purpose of the Fund.

“NETF Training Award”, or words importing a similar effect or meaning refers to the awards or funding scheme administered, run or managed by NTUC.

“Trainee” refers to the individual approved for the NETF Training Award and undertaking approved training courses under NETF.

“Training Provider” refers to the supplier of training courses approved under NETF.

“Approved Course(s)” refers to course(s) approved by NETF.

WHEREBY IT IS AGREED as follows:-

1. The agreement between NTUC and the trainee shall consist of this agreement and shall include any other written document agreed to in writing by the parties from time to time in connection with this agreement during the duration of the training period for the approved course. In the event of any ambiguity or conflict between this agreement and any other written document entered into between the parties, the terms and conditions of this agreement shall prevail.

2. The NETF Training Award shall be awarded to union members who fulfill the criteria as stated below and undertake any of the courses listed by the NETF and NETF reserves the right to accept, amend or reject any application for the Training Award. The amount of the award is determined by NETF. For the avoidance of doubt, application for the NTUC Surrogate Employer Programme (“NTUC-SEP”) shall be made separately and trainee shall therefore adhere to the terms and conditions of the NTUC-SEP as stated therein.

3. The trainee must satisfy all NETF criteria in order to be eligible for funding support:

NETF criteria:

i) Must be union member at point of application submission and course commencement

ii) Maintain paid-up union membership throughout entire course duration and at the time of claim

iii) Capped at the maximum claim of $250 in a year

iv) Must achieve a minimum of 75% attendance for each application and sat for all prescribed examinations

v) Course must be pre-approved by NETF; and

vi) NETF must not have funded the same course at the same time through the employer or any other parties or arrangements. Non satisfaction of any of the above criteria may result in the revocation of the funding support already granted, if any.

4. NTUC does not warrant the quality of the approved course conducted by the training provider and makes no representation whatsoever in respect of the approved course of the training provider. In the event the training provider stops providing the course at any time for any reason (including but not limited to lack of commercial viability of the training provider), the trainee shall not seek any reimbursement or any form of compensation whatsoever form, or take any legal action against NTUC, its employees and/or agents in respect of course fees already paid to such training provider or any such other costs incurred.

5. NTUC, its employees and/or agents shall not be liable to the trainee for any loss, damage, charges and costs whatsoever arising from and/or incurred by reason of any negligent act and/or omission of the training provider, its employee(s), agent(s), sub-contractor(s) and/or representative(s) during and/or after the approved course.

6. NTUC reserves the right to expel any trainee from the approved course or reject any claim for funding support without giving notice or assigning any reason for such expulsion or rejection.
